US court overturns death penalty of Boston Marathon bomber | News

A federal appeals court on Friday overturned the death sentence of Dzhokhar Tsarnaev, the man convicted in the 2013 Boston Marathon bombing.

The three-judge panel of the 1st US Circuit Court of Appeals in Boston issued the decision (PDF) more than six months after arguments were heard in the case.

The court in Boston upheld much of Tsarnaev’s conviction but ordered a lower-court judge to hold a new trial strictly over what penalty Tsarnaev should receive for the death-penalty-eligible crimes for which he was convicted. 

The April 15, 2013, attack killed three people and injured more than 260 others.

Tsarnaev’s lawyers had argued that intense media coverage had made it impossible to have a fair trial in Boston. They also pointed to social media posts from two jurors suggesting they harboured strong opinions even before the 2015 trial started.

The appeals judges, in a hearing on the case in early December, devoted a significant number of questions to the juror bias argument.

They asked why the two jurors had not been dismissed, or at least why the trial judge had not asked them follow-up questions after the posts came to light on the eve of the trial.

The judges noted that the Boston court has a long-standing rule requiring such an inquiry.

Tsarnaev’s lawyers said one of the jurors, who would go one to become the jury’s foreperson, or chief spokesperson, published two dozen tweets in the wake of the bombings. One post after Tsarnaev’s capture called him a “piece of garbage”.

Tsarnaev was convicted on 30 charges, including conspiracy and use of a weapon of mass destruction. He’s been serving his sentence in a high-security supermax prison in Colorado.

His brother, Tamerlan Tsarnaev, was killed in a gun battle with police days after the two brothers detonated two pressure-cooker bombs near the marathon finish line.

STATEMENT
Today in Kamwenge, as we have done since the start of the campaign season, we headed out to speak with the people. We had earlier in the week agreed on the venue with security agencies. No one had anticipated that it would rain as much as it did, making it impossible for us or the people to access.

After identifying an alternative place only 100m away from the original venue, negotiating with the owner and communicating the same to the public, we headed to the second venue only to be stopped by police.

Our policy has always been to do all we can to be reasonable, even in the face of unreasonable action on the part of the state. We engaged the police leadership in a civilized, respectable manner well knowing that they intended to not only frustrate us, but cause us to act in ways that would give them an excuse to cause chaos. This was on top of their intimidating the radio we had booked and duly paid to appear on.

While we are confident that we are on the right side of both the law and reason, we have chosen not to endanger the lives of our supporters or the general public by escalating the situation. We will do everything humanly possible to avoid a single life being lost or blood being shed on account of our campaign.

And yet this truth remains: the regime’s days are numbered.
